Borgia resigns as top Westchester legislator after losing case to stop her ouster

A week-long push by Westchester County lawmakers to oust their leader came to a head on Friday when she lost a lawsuit to block them and resigned shortly before they were set to remove her.

Catherine Borgia, chairwoman of the 17-member Board of Legislators, had sued on Wednesday and won a temporary order that prevented her colleagues from voting that day on her removal. But that barrier was lifted on Friday when acting state Supreme Court Justice Robert Prisco dismissed the case, which had argued the board had no power to depose her.

WHITE PLAINS – Judge Robert Prisco Friday lifted a temporary restraining order issued earlier in the week that stopped the Westchester County Board of Legislators from holding a special meeting on Wednesday.

Following this ruling, Chairwoman Catherine Borgia submitted a letter of resignation vacating her leadership position to the clerk of the board.

According to the rules of the board, Vice Chairwoman Nancy Barr will become acting chair for a maximum of 60 days.  Read more at Borgia steps down as Westchester legislature chair - Mid Hudson News

A state Supreme Court judge is expected to rule today whether the Westchester County Board of Legislators can remove its chairwoman from her position.
A temporary injunction was issued Wednesday after Board Chair Catherine Borgia filed a lawsuit claiming the Board of Legislators does not have the legal right to remove her.
Lawyers for the county are asking the judge to throw out that lawsuit. This stems from allegations against a former legislative aide brought forward by a group called OBL Global, which posted a YouTube video allegedly showing the aide sending lewd messages and pictures to a decoy 14-year-old girl.  In a public resolution, the Board of Legislators claims Borgia was made aware of these allegations back in December but allowed the employee to continue working until she fired him earlier this month........MORE AT State Supreme Court judge to rule whether Westchester can remove Board Chair Catherine Borgia (news12.com)
