Parents Defending Education v. Croton-Harmon school district: Federal judge dismisses case--just what PDE asked for.

A hearing in front of U.S. Judge Cathy Seibel to set a schedule for the plaintiff's motion for a preliminary injunction, and defendant's deadline to Answer the Complaint, takes an unexpected turn.

WHITE PLAINS—A thirty minute hearing in front of U.S. district judge Cathy Seibel of the Southern District of New York (SDNY) White Plains branch gave the plaintiffs, Parents Defending Education and three anonymous Croton-Harmon parents, pretty much everything they asked for. Judge Seibel dismissed the case as well as PDE’s motion for a preliminary injunction that would block the school district from enforcing its anti-harassment, anti-bullying, anti-racist, and pro-DEI policies.

UPDATE FROM THE CROTON CHRONICLE: 

Parents Defending Education appeals dismissal of its lawsuit against the Croton-Harmon school district to U.S. Court of Appeals for the Second Circuit.

Following its carefully planned strategy, the plaintiffs in the lawsuit wasted no time filing an appeal of the decision they had asked U.S. Judge Cathy Seibel to make.

As we reported yesterday, after a half-hour hearing with the plaintiffs, Parents Defending Education, and the defendants, the Croton-Harmon school district, U.S. District Judge Cathy Seibel granted PDE’s request for her to dismiss the case so that PDE could take some issues of judicial precedents up on appeal.

The plaintiffs wasted no time in doing so. Today, PDE’s attorneys filed notice with the court of their appeal to the U.S. Second Circuit Court of Appeals, located in lower Manhattan. As we discussed in our earlier coverage, getting Judge Seibel to dismiss the case was an integral part of PDE’s legal strategy to put at least some of the issues in the lawsuit before a higher court, and eventually the U.S. Supreme Court. This email is being shared by the Village as it represents an issue of potentially broad interest to the community.

Dear Community Members,

As we progress in redesigning and upgrading Spencer Field, we want to provide you with an update on the upcoming blasting activities necessary for field improvements and electrical service upgrades.

Weather permitting, we anticipate the work beginning on Friday, July 12, and lasting through the first week of August. The controlled blasting will be conducted intermittently between the hours of 11:00 AM and 3:00 PM. To alert nearby individuals and workers, audible horn warnings and "all clear" signals will be sounded before and after each blasting, as indicated below.
